British national Darren Leh and Joy Rajvinder Kaur Bens, an Indian national settled in UK, have been arrested and another partner, Rayon Courtney Welmons, has been booked.
The action was taken on a complaint filed by Yogesh Nayak (49), a senior officer from the commerce department of the Government of India in Mumbai.
Deputy commissioner of police Sanjay Jadhav said that the BPO had signed a bond of Rs 94 lakh with the government to set up its business in India. The BPO got several facilities and concessions from the government.
Jadhav said that on July 14, 2010, the BPO purchased a UPS system on which they were given a duty waiver of Rs 69,184. On the same day the company purchased four air-conditioners and got a duty waiver of Rs 84,078. Later, on November 9, 2010, the company got a duty waiver of Rs 2,68,074 on the purchase of 100 computers, leading to a total duty waiver of Rs 4,21,338.
Jadhav said that the BPO had failed to give the expected financial returns to the government as well as its employees.
He said the BPO had also paid money to some private firms from which it had purchased the computer machinery and on February 22, 2011, the directors of the Epitome BPO Services stopped operations of their unit in Kharadi without informing the development commissioner, Mumbai (commerce department, Government of India).
A Mumbai-based trader Rahul Khokle had complained to the development commissioner's, saying that the BPO had purchased computer networking machines and Microsoft software worth Rs 42 lakh, but had not paid the money, following which Nayak registered a complaint, Jadhav added.
The police have charged the suspects with committing offences under Section 420 read with 34 of the Indian Penal Code (IPC). Leh and Bens have been sent to police custody till March 4.
